What are consulting and non-consulting services in bidding?
Regarding this issue, Law Library answered as follows:
1. What are consulting and non-consulting services in bidding?
According to Clauses 8 and 9, Article 4 Bidding Law 2013 stipulates consulting and non-advisory services in bidding as follows:
- Consulting service in bidding is one or several activities including:
+ Prepare and evaluate planning reports, development and architectural master plans;
+ Survey, make pre-feasibility study report, feasibility study report, environmental impact assessment report;
+ Survey, design, estimate;
+ Prepare dossiers of invitation for expression of interest, dossiers of invitation for pre-qualification, bidding dossiers, dossiers of requirements;
+ Evaluation of dossiers of expression of interest, dossiers of pre-qualification, bid dossiers, dossiers of proposals;
+ Verification and appraisal;
+ Supervision;
+ Project management;
+ Financial arrangements;
+ Audit, training, technology transfer;
+ Other consulting services.
- Non-consulting services in bidding are one or several activities including:
+ Logistics;
+ Insurance;
+ Advertising;
+ Installation not specified in Clause 45, Article 4 Bidding Law 2013 including jobs in the process of construction and installation of works and work items.
+ Acceptance and test run;
+ Organizing training;
+ Maintenance;
+ Maintenance;
+ Draw maps;
+ Other activities other than consulting services.
2. Method of evaluating bids with consulting service bidding packages
The method of evaluating bids for consulting services bidding packages according to Article 40 Bidding Law 2013 is as follows:
(1) For the consulting contractor being an organization, one of the following methods shall be applied:
(1.1) The lowest price method is applied to simple consultancy bidding packages. Bid evaluation criteria are technical evaluation criteria.
